Step 3: Requirements to start your own business

Before you can start trading as a self-employed worker, civil law requires you to comply with a series of requirements, together with relevant training qualifications. These requirements include:

  • Being of legal age (at least eighteen years of age).
  • Having Belgian nationality or the nationality of a Member State of the European Economic Area (EEA). If this is not the case, you will need a Professional Card to set up a business in a self-employed capacity in Belgium.
  • Having full civil rights. Which first and foremost means you have never previously been convicted for fraud or bankruptcy on the grounds of gravely wrongful acts.
  • Holding a number of mandatory permits.
  • Being able to bring proof of your entrepreneurial skills by way of a qualification or practical experience (this does not apply to the self-employed worker's assistant or assisting spouse).
  • Having legal capacity.
